Inheritance and Legal Heir Certificate – Procedure in Himachal Pradesh for Land Owners

When a landowner in Himachal Pradesh passes away, their legal heirs must take timely steps to have their names entered in the official land records. This process is known as inheritance mutation. For this, a Legal Heir Certificate (also known as a waris certificate) is often required to prove the relationship between the deceased and the surviving heirs.
Understanding the correct procedure is essential to avoid future disputes, ensure smooth mutation, and preserve ownership rights.
What is a Legal Heir Certificate?
A Legal Heir Certificate is an official document issued by the Tehsildar or Naib Tehsildar that identifies all surviving legal heirs of a deceased person. It is not a proof of ownership, but a certificate that helps revenue officials determine who is entitled to inherit land or property.
It is required for:
- Mutation of land after the death of a landowner
- Withdrawal of pension, insurance, or gratuity
- Settlement of disputes among family members
- Transfer of electricity or water connection
- Filing of civil suits or applications
Who Can Apply?
Any surviving legal heir, such as:
- Spouse (widow or widower)
- Children (sons and daughters)
- Parents (if alive)
- Siblings (if the deceased was unmarried and childless)
In Hindu families, the Hindu Succession Act governs the order of inheritance. For Muslims, inheritance is governed by personal law. In case of a registered will, the beneficiaries under the will inherit the property.
How to Apply for a Legal Heir Certificate in Himachal Pradesh
Step 1: Prepare the Application
An application is to be submitted to the concerned Tehsil office. It must include:
- Full name of the deceased
- Date and place of death
- List of legal heirs with relation and age
- Khasra numbers and details of land (if known)
Step 2: Attach Required Documents
- Copy of death certificate
- Aadhaar and identity proof of applicant
- Jamabandi of land (if for land inheritance)
- Affidavit declaring legal heirs
- No-objection certificate (NOC) from other heirs (optional but helpful)
Step 3: Verification by Patwari
The Patwari will conduct a field inquiry, verify local records, and confirm the heirs.
Step 4: Issue of Certificate
Once satisfied, the Tehsildar will issue the Legal Heir Certificate. This certificate is then used to apply for mutation of land in the names of the heirs.
Mutation of Land Through Inheritance
After obtaining the legal heir certificate, the next step is to apply for mutation (intkal) in the land records.
Documents Required:
- Legal heir certificate
- Copy of death certificate
- Jamabandi of the land
- Identity proof of heirs
- Partition deed (if division is already done)
The Patwari enters the mutation in Roznamcha Waqiati, and the case is heard by the Tehsildar or Naib Tehsildar, who will pass an order to mutate the land in the names of heirs.
